Terms and Conditions of Service
Note: By requesting, booking, approving, or accepting services from Nuisance Wildlife Control Inc. (“NWC Inc.”), you confirm that you have read and agree to these Terms and Conditions of Service. These Terms form part of the agreement between you and NWC Inc.
1. Estimates and Quotes
For the purposes of this Agreement, the terms “estimate” and “quote” are used interchangeably and represent an anticipated cost based on the information available at the time of inspection or booking.
All estimates and/or quotes are valid for 30 days from the date issued unless otherwise stated in writing.
All estimates and/or quotes are subject to adjustment if site conditions differ from those disclosed, access is restricted, additional work is required, material cost changes occur, or the scope of work changes.
If material changes to scope or pricing are identified during service, NWC Inc. will communicate such changes to the Client prior to proceeding with additional work.
2. Client Safety
Client agrees to avoid any direct contact with wildlife and/or rodents of any kind during NWC Inc.’s service.
3. No Tampering with Equipment
Client will not touch or tamper with any NWC Inc. traps, cameras, or equipment. Damage caused to these items as a result of a Client’s tampering may result in additional fees.
4. Lost, Stolen, or Damaged Equipment
If any trap and/or monitoring equipment is found missing, stolen, and/or damaged, the Client will be held liable for replacement costs as determined by NWC Inc.
5. Limitation of Responsibility for Injury or Damage
NWC Inc. is not responsible for any personal and/or property damage caused by animal(s) in traps and/or any damage incurred as a result of the services rendered by NWC Inc. at any time.
NWC Inc. will not be held liable for any personal injury to the Client(s), family member(s), pet(s), neighbour(s), or otherwise, in connection with a wild, trapped, and/or escaped animal.
Clients are advised to notify neighbours of the existence of traps and equipment and advise them to keep children, pets, and themselves away from the area(s) in which traps and equipment are located.
6. Animal Removal Response
When contacted about the presence of animal(s) in a live trap, NWC Inc. agrees to return as scheduling permits to remove the animal(s).
7. Removal of Non-Target Wildlife
NWC Inc. will automatically remove any non-targeted wildlife trapped during its services. If a Client does not want non-targeted animals removed, the Client must notify the office prior to services commencing.
8. Equipment Retrieval
Absent extended services agreed upon through acceptance of a new estimate or quote, NWC Inc. will retrieve traps, cameras, and equipment at the time of the final visit.
If a Client desires to extend service, they must contact NWC Inc.’s office prior to the final visit to make arrangements.
9. Weekend and Holiday Service
For services occurring over weekends and/or holidays, NWC Inc. reserves the right to set off traps on the Friday prior.
10. Right of Access and Monitoring
Client grants NWC Inc. the right to access, work, and/or monitor traps as required by Provincial and Federal laws. This may include Remote Video Recording.
Client authorizes NWC Inc. to use audio and visual recording where required for monitoring and compliance purposes.
11. Subcontracting
Client acknowledges and agrees that NWC Inc. may engage qualified subcontractors or independent contractors to perform some or all services under this Agreement. NWC Inc. remains responsible for coordination, quality, and completion of services and will ensure compliance with these Terms.
12. Safe Access Requirement
Client agrees to provide safe, unobstructed access to the premises during scheduled service times, including attics, crawlspaces, roofs, and other required areas.
Client must disclose known hazards (including aggressive pets, unsafe structures, exposed wiring, or other risks) prior to commencement of services.
13. No Guarantee of Capture
While NWC Inc. strives to provide effective service, no guarantees are made regarding the trapping of contracted animal(s).
Due to the nature of wildlife, NWC Inc. cannot guarantee that once removed, an animal will not return.
14. Possible Attraction of Other Wildlife
Client understands that exterior traps may attract other wildlife or domestic animals to the premises.
15. Fees Due Regardless of Capture
Client remains responsible for approved trapping fees even if no animals are caught.
If trapping is unsuccessful, NWC Inc. may recommend an alternate program, which will require approval through a new estimate or quote.
16. Ladder Inspections
Provided access and height requirements permit without risk of harm, NWC Inc. may perform ladder inspections during service.
NWC Inc. cannot guarantee locating the access/entry point(s) of target animals.
17. Repair Work
If entry point(s) are located, repair costs will be discussed and a new estimate or quote provided for approval prior to completion of such work.
18. Cosmetic Considerations
Repair work will prioritize effectiveness in restricting animal access and may not always meet cosmetic preferences.
If the Client engages an outside contractor for cosmetic modifications, such work is at the Client’s sole expense.
NWC Inc. is not responsible for any compromise to repair effectiveness after alterations are made by the Client or third parties.
19. Third-Party Repairs
If NWC Inc. identifies required repairs it cannot perform, the Client is responsible for sourcing a contractor promptly.
Any associated costs are the Client’s responsibility.
20. Payment Terms
All approved fees and expenses are payable in full at the time of service unless otherwise agreed in writing prior to commencement.
If payment is not received at the time of service, a $25.00 dishonour fee will be charged and added to the amount due.
21. Late Payment Finance Fee
Any unpaid fees 30 days following completion of service will be subject to a finance charge of 2% per month (24% per annum).
22. Collection Costs
Any legal fees and/or expenses incurred in connection with the collection of unpaid fees, returned payments, or damaged equipment will be charged to the Client.
23. Cancellation After Setup
If traps or equipment have been set prior to cancellation, the Client remains responsible for setup and initial service fees.
24. Additional Insurance
Requests for additional insurance coverage beyond NWC Inc.’s existing policy limits must be discussed prior to approval, as additional fees may apply.
25. Force Majeure
NWC Inc. shall not be liable for delay or failure to perform services due to causes beyond reasonable control, including severe weather, labour disputes, illness, acts of God, equipment failure, or government restrictions.
Services will be rescheduled as soon as reasonably possible.
26. Limitation of Liability
To the fullest extent permitted by law, NWC Inc.’s total liability for any claim arising out of this Agreement shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.
27. Privacy
Any recordings or Client information collected by NWC Inc. are used solely for providing services and complying with regulations and will not be shared except as required by law.
28. Right to Cancel
Client is entitled to a copy of the approved estimate or quote and these Terms and Conditions of Service and has the right to cancel this contract within 72 business hours following approval, provided services have not yet commenced.
